John Oliver and hbo were then sued by companies for filming this episode because it appeared on a computer monitor.

Austin Meyer that were shortly featured around the 1:50 mark made his own documentary about his patent lawsuit and and how these patent trolls operate and how they are connected to the senate and so forth. The movie goes by the name The Patent Scam and are defiantly worth 2 hours of your time, so check it out :D

In Canada if you bring a law suit against someone and you lose you havetio pasty their legal fees... Strange how this stuff dosen't happen as much here...

I must've time traveled to watch this video cause the timing for me 3 years later is so appropriate. I told my friend about you mentioning settling without a lawyer. But in his case, there might be royalties involved that could go on indefinitely, so even $700.000 would probably be a drop in the bucket. Just a guesstimate my friend was talking about.

The raccoon/garbage can challenge was made into a cartoon in a series because I told all of my friends how my ex would wake up every morning to do battle with the same raccoons for toppling the same cans over even though he secured the tops with the same bungee cords. It became so ridiculous that I even suggested that he buy new bungee cords. Somehow he thought using the same thing, but changing the color would give you different results.

This happened to the youtuber couple h3h3productions when fighting for fair use on youtube and other platforms. They fought the case, and won so they set a legal precedent for not getting bullied around by anyone on youtube that doesnt like if you say their name funny in a video.

Why aren't the patent trolls forced to pay the legal costs if they lose? Isn't that possible in US law?

Harry Reid the DEMOCRAT majority leader in 2015 was the SOLE person who blocked the Senate Bill. This video is crystal clear PROOF that Comedy Central has a severe political bias. Even CNN would admit Harry Reid is a corrupt piece of shit but Comedy Central blames the lawyers and doesn't even mention Harry Reid once...

People like these patent parasites deserve the worst that Hell has to throw at them. In the Xerox case he mentioned that lawsuit shouldn't have leg to stand on.... the feature was built into the machine and I'm using it. I don't owe you jack nor shit. That's a problem between you and Xerox if it's a patent-infringement... Has zero to do with the end-user.

patents are detrimental to the technological advancements of the human race. imagine homo habilis patenting an eye-shaped stone tool forcing other homininis to either pay up or using bare hands. each and every human being is free to combine all and every element in the universe. the universe is one and atoms are created for all of us. you can own a given piece of matter - but not the way molecules are arranged. that would be ridiculous. patents are the way to extort from other smart people - with the help of the greatest mafia machine out the - state machinery

Since Apple doesn't allow comments, and probably only invented a Cow image, I'll just leave this here for you all... Apple claimed the GUI, which actually originated at Xerox PARC, if I'm not mistaken Ken Thompson and Dennis Ritchie made UNIX at Bell Labs, which macOS is (specifically the MACH Kernel) macOS is in turn based on NeXTSTEP And, the bonus Fact Of The Day: Microsoft didn't come up with GUIs that snap to different sides, or virtual desktops; KDE did, I believe. :)

Why don't they just put a dome over the entire state and isolate themselves from the rest of us peons, since they are so obviously better that everyo e else, NOT, fuck them first FEMA.

Patent procedure even in here is quite tiresome. You have to search for similar patents if it isn't something completely new from component to component. You have to search all the corresponding patents then fill up the documents which take a lot of fees and then as you apply the patent in the patent office you have to wait for the department to give you an answer. Meanwhile it is searched for other patent infringements which you already did and for the possible existence of the idea of the patent. You wait almost a year to hear back and if you're lucky probably 3 months.

Funny enough, it's similar to how some businesses or companies try to get YouTube to take down content they have no ownership of and sometimes content the channel owns, taking advantage of the fact that YouTube doesn't check such claims first.

I've been through the patent process before and let me tell you, it is a pain to deal with. Researching beforehand to make sure that your idea doesn't infringe on pre-existing ideas is nearly impossible And without a lawyer, that process becomes 10x harder. I actually got a patent denied because aspects of the design were similar to something that someone else had used for a completely different idea unrelated to what I was trying to patent. I honestly feel so sorry for companies who have to deal with patent trolls. Aside from them, my main issue with our patent system is how it can really put a stop to innovation. While it is essential, especially for small businesses who fear that without protection their ideas will be stolen and used by larger companies, it makes it difficult to combine ideas and innovate without infringing upon others ideas. There was an issue a while back where the creators of the wikipad sued Nintendo for their joycon design due to patent infringement. They wanted to have Nintendo halt all sales of the Switch, which is a ridiculous demand. The worst part is, the wikipad hasn't been on the market for years.

I’m surprised apple wasn’t mentioned because they took the open source haptic engine, renamed it to Taptic Engine, and tweaked it very slightly and then patented it. So really they are a patent troll.
Ulquiorra Cifer (7 months ago)
They should have a policy stating that you lost patent rights if you do not utilize it within a year or some other period of time. Utilize being producing a product or licensing it.

One MAJOR aspect of the debate has been completely left out: why the fuck is it legal to patent living beings?! Why is he not talking about Monsanto? It's not like EVERYONE has to eat food on a daily basis, just in order to survive Oh. Wait. It is!

intellectual property in technological areas should be largely a non-issue all the manufacturer has to do is not release the source code of their program and it becomes a lot harder to just copy it. in the event that it is copied, then assuming the company has already garnered somewhat of a client base then they should be fine, youtube has a million clones, but youtube is the most popular because it delivers a better user experience and has an established client base it's the same with google, facebook, or tinder. they aren't selling technology, they are selling a user experience, and they will only get knocked down if someone creates a compelling alternative or improvement on them, which is healthy competition. in the case of these companies their brand is more valuable than their search engine, video platform, social media outlet or dating app. the only major area where this does not apply is the area of developer tools like adobe after effects, digital animation tools, word processors, video game engines, or computer programming compilers. these tools perform complex tasks and produce a tangible product, as opposed to a service, or user experience. In every other field, there is simply no grounds for arguing that intellectual property be respected, if somebody makes something better, people will use it instead, if somebody can reverse engineer just by looking at it, you haven't done anything special

When society no longer functions, then all is fair game, and thus if a lawyer on behalf of a patent troll threatens to sue which will destroy your livelihood, you threaten their life. They take you to court, you kill them. If society functioned, then the need to resort to violence wouldn't be necessary, but we don't live in that country.

Why even respond to the lawsuits? I am honestly asking... what happens if you just ignore a lawsuit?
TheYummyKenshin (9 months ago)
If you don't respond, they win by default and can pretty much get the full value for the case. At that point they can pretty much do whatever to get their money like garnishing your wages.
